The Bundesnotarkammer (hereinafter referred to as “BNotK” or “we”) takes the protection of your personal data, e.g. information on personal and factual relationships of an identified or identifiable natural person, very seriously. In this privacy policy, we would like to inform you in detail on the data we process when you use our website as well as on the purposes of their processing.

3. Processing of personal data

The collection, processing and use of your personal data is made in strict compliance with the provisions laid down in the European General Data Protection Regulation 2016/679 (hereinafter referred to as “GDPR”). When you visit our website, personal data is therefore only collected, processed and used to the extent that this is permitted by law. This also applies to the transfer of personal data. The processing of your personal data is carried out exclusively in our data centres located in Germany.

a) Usage data

Each time you visit our website, your web browser transfers the following data:

  • date and time of the request,
  • name of the requested file,
  • page from which the file was requested,
  • access status (file transferred, file not found, etc.),
  • web browser and operating system used,
  • complete IP address of the requesting computer,
  • amount of data transmitted.

We process these usage data in order to make our website accessible to you, to identify and rectify any technical problems that may occur as well as to prevent and, if necessary, track any misuse of our services.

The legal basis for the processing of your usage data are Article 6(1) lit. f GDPR and Sections 78 et seqq. of the Federal Code for Notaries (Bundesnotarordnung, BNotO).

The storage period of your usage data does not exceed 30 days.

b) Data that you transmit to us

On our website you have the possibility to contact us and, for example, ask questions concerning our services or request technical support.

If you use the contact form on our website and send a text message to bnotk[at]bnotk.de by clicking on the “send” button, the following personal data will be processed:

  • master data (name and surname – name optional),
  • contact details (phone (optional), e-mail),
  • your text message.

We use these personal data only in order to process your request.

Article 6(1) lit. b GDPR is the legal basis for this data processing if a customer relationship already exists or precontractual relations are being established. In all other cases, the legal basis are Article 6(1) lit. e GDPR and Sections 78 et seqq. BNotO. Furthermore, we may store your personal data for evidence purposes to establish, exercise or defend legal claims. In this context, the legal basis are Article 6(1) lit. c GDPR, Section 257(4) German Commercial Code (Handelsgesetzbuch, HGB), and Section 147(3) German Fiscal Code (Abgabenordnung, AO).

Our website uses TLS encryption to protect the transmission of confidential content such as contact requests you send us.

c) Login into the protected area

When you log into the protected area on our website, a typo3 cookie is set as a so-called session cookie; it is called “fe_typo3_user”. Typo3 cookies are technically necessary cookies and are used to identify sessions and to enable the use of the login area. Thus, only the information that you have successfully logged in is stored.

Typo3 cookies are only valid for the current browser session and are deleted as soon as your browser is closed.

4. Transfer of your personal data to third parties

Your personal data will not be transferred to third parties for purposes other than those listed hereafter:

  • to the Rockenstein AG, Ohmstraße 12, 97076 Würzburg, which operates our data centre
  • to the Goldland Media GmbH, Immanuelkirchstraße 12, 10405 Berlin, which is responsible for fixing technical problems occurring when accessing the website or during login.

In accordance with Article 28 GRDP, all data processors must provide sufficient contractual guarantees to implement appropriate technical and organisational measures in order to ensure the protection of your personal data.

5. Your rights

You have the following rights regarding the processing of your personal data by the

Bundesnotarkammer:

  • Right of access (Art. 15 GDPR),
  • Right to rectification (Art. 16 GDPR),
  • Right to erasure (Art. 17 GDPR),
  • Right to restriction of processing (Art. 18 GDPR),
  • Right to data portability (Art. 20 GDPR),
  • Right to object (Art. 21 GDPR) in cases where we process your personal data on the basis of Art. 6(1) lit. e GDPR.

6. Right to lodge a complaint
